U.S. Department of Labor Decision

December 17, 2021 Dear Mr. Roldan: Your complaint to the Department of Labor protesting the June 24, 2021 election of officers in LIUNA Local 78 in Long Island City, New York has been investigated pursuant to Sections 402 and 601 of the Labor-Management Reporting and Disclosure Act of 1959. Following a review of the investigative findings by this office and the Office of the Solicitor, Division of Civil Rights and Labor-Management, a decision has been made that those findings do not provide a basis for action by the Department to set aside the protested election. End of Year Updates

Dear Brothers and Sisters: As this year comes to a close and we look forward to the coming year, it is our sincere hope that you and your family are safe and healthy and enjoying the holiday season. We wanted to take this opportunity to report to you on some decisions, and actions your Executive Board, and trustees have taken that will be of interest to you. DUES Last year at the height of the COVID-19 pandemic, the monthly dues for apprentices were reduced to $20 per month. The Executive Board has acted to keep the monthly dues for apprentices at $20 for 2022. At the end of this year the monthly dues for members were scheduled to increase $2.00 per month, from $38 per month to $40. The Executive Board has asked the International Union for a variance to allow for a $1.00 increase, raising the monthly dues to only $39 for 2022. LEGAL SERVICES The Board of Trustees of the Local 78 Legal Services Plan have announced that effective January 1, 2022 the plan has been modified as it relates to immigration and naturalization services. The eligible member, the member's spouse and the member's child will now be eligible for this service. The number of hours covered under the plan for this service will also increase from 8 hours to 25 hours per year. Further details of this new and expanded benefit will be provided to you from the Trustees in the coming weeks. LOCAL 78 CHARITABLE CORP. This past year Local 78 established a new charitable foundation to benefit the members of the Local. This New York non-profit corporation was established to benefit the members of Local 78. Additional Pension Payment

Dear Pensioner/Beneficiary: On behalf of the Board of Trustees of the Mason Tenders' District Council Pension Fund, we are pleased to inform you that an additional benefit check in the amount of $1,100 has been granted to all pensioners and beneficiaries (including surviving spouses) that are in pay status in the month of December 2021. If you receive your monthly pension payment by check, the check is enclosed with this notice. Final Decision of LIUNA Special Hearings Panel Regarding Election Protest at Local Union 78

Brothers and Sisters: On September 17, we received the final decision from the LIUNA Special Hearings Panel regarding the Election Protest at Local 78. The decision was reviewed and approved by the General President in accordance with the International Union Constitution, Article VIII, §2 (a-vii). A brief summary of the decision follows: "Following a July 27, 2021 notice, a hearing on the Election Dispute filed by Jorge Roldan was held by Zoom videoconference on August 23, 2021. LIUNA Vice Presidents Terrence M. Healy and Rocco Davis served on the Special Hearings Panel. LIUNA Associate General Counsel Lisa Pau advised the Panel. "For the reasons stated in the letter linked above, the Panel finds that the objections claimed by Brother Roldan and his legal counsel, Mr. Larry Cary, are without merit. Having carefully considered the testimony and evidence presented, the Panel concludes the results of the election at Local Union 78 should stand."

Local 78 Executive Board Sworn In

Local 78 elections are now finalized and Pawel Gruchacz and the entire 78 Unity Slate have won. At a packed in-person union meeting on July 27, 2021, in Queens, NY the new officers were sworn in. LiUNA Vice President and Eastern Regional Manager Raymond M.
